Katz’s Deli in New York is well known as a purveyor of classic sandwiches and other delicatessen staples. But is its name so synonymous with its trade that another business is infringing?
That’s what Katz’s is now arguing, according to Reuters. The food truck chain Katz & Dogz sells the kind of fare that the original Katz is well known for. So much so that the deli is pursuing legal action, saying that the food truck is unlawfully taking advantage of the more established Katz brand. The Deli has been in business for more than a century.
This can be something that many vendors and food producers need to consider, especially if they’ve created their own name without thinking through the ultimate legal circumstances. “Without the consent of the plaintiff, the defendants have opened mobile food trucks and a mobile food cart under the brand name ‘Katz & Dogz’ that sell the same Jewish deli foods as Katz’s Deli,” it reads. “The defendants’ actions blatantly infringe plaintiff’s federal trademark registrations and will continue to cause irreparable harm to the plaintiff’s goodwill and reputation.”
Whether or not it was on purpose, the name on the banners and signs for the trucks almost certainly suggest to New York deli-goers the well-known restaurant and the fare that it offers.
