The popular pomegranate-based juice company Pom Wonderful is well known for its distinctive bottles and allegedly healthful beverages, but it is taking on the giant Coca Cola on allegations that this company’s own attempt at a similar drink is falsely advertised.
According to the coverage of this event by Bloomberg, the juicemakers are taking Coke to task on the grounds that the latter’s “Pomegranate Blueberry Flavored Blend of 5 Juices” actually contains very little of the top two fruits mentioned on the bottle. Instead, most of the drink is said to be composed of apple and grape juice.
The problem lies in the way this description might violate FDA regulations by making consumers think the drink contains a different proportion of ingredients than it actually does. But the case, which seems to have been going since 2008, might have an impact on the way that the government and businesses consider the process of making labels for different product lines.
Bloomberg quotes from an email from Coke, which is defending its practices and banking on the consistent support they’ve received from the government in the ongoing battle.
“We are confident our labeling fully complies with applicable FDA regulations, as the lower courts have consistently found,” the company said in a statement.
But confidence isn’t where the process ends, and Coke will have to defend against its rival’s claims in court.
